1. Introduction
These Terms and Conditions govern your use of the website bm-elements.com and the services and products provided by BM•ELEMENTS at our studio in Porto, Portugal, and through our online store. By using this website, making a booking, or purchasing a product, you agree to these Terms.
2. About Us

3. Services
BM•ELEMENTS offers body massage, facial massage, LPG Endermologie®, beauty treatments, and aesthetic medicine services. Some services are provided by independent specialist partners working within our studio. Service descriptions and prices are listed on bm-elements.com and are subject to change. We reserve the right to update pricing with reasonable notice.
4. Bookings and Cancellations
Bookings are made through the Fresha platform (fresha.com). Fresha’s own Terms of Service apply to the booking process. We ask that you cancel or reschedule at least 24 hours before your appointment. Late cancellations or no-shows may result in a cancellation fee at the studio’s discretion. We reserve the right to refuse or cancel a booking if we are unable to safely or appropriately provide the requested service.
5. Online Store
Our online store is operated through the Fresha platform. When you purchase a product through our store, your order and payment are processed by Fresha under their Terms of Service and Privacy Policy. Products are dispatched or available for collection at the studio as specified at the time of purchase. We reserve the right to update product availability and pricing at any time.
6. Health and Safety
Certain services may be contraindicated depending on your health condition. It is your responsibility to inform your therapist of any relevant medical conditions, injuries, pregnancy, or allergies before treatment. BM•ELEMENTS reserves the right to decline or modify a treatment if, in the professional judgement of the therapist, it may pose a risk to your health. This applies equally to all services provided by specialist partners within the studio.
7. Packages
Service packages are non-refundable once purchased. Packages are valid for the period stated at the time of purchase. An extension of 25€ is available should the validity period expire. Packages are personal and non-transferable.
8. Gift Cards and Certificates
Gift cards are valid for 6 months from the date of issue. Gift cards purchased in person at the studio are non-refundable. Gift cards purchased online are subject to a 14-day right of withdrawal in accordance with Portuguese consumer law (Decreto-Lei n.º 24/2014). To exercise this right, contact us at oksana@bm-elements.pt within 14 days of purchase. The right of withdrawal does not apply if the gift card has been partially or fully redeemed.
9. Payments
Payments are processed securely through Fresha and their payment providers. We do not store payment card details. Prices are displayed in euros and include applicable taxes.
10. Limitation of Liability
BM•ELEMENTS is not liable for any indirect, incidental, or consequential loss arising from the use of our services, products, or website, except where such liability cannot be excluded under applicable Portuguese law. Our total liability is limited to the value of the service or product purchased.
11. Intellectual Property
All content on bm-elements.com — including text, images, and design — is the property of BM•ELEMENTS and may not be reproduced without prior written permission.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Changes take effect upon posting to this website. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Porto.
